The Wisconsin State Legislature and Governor Tony Evers have approved 2025 Act 172, which makes Wisconsin’s Assured Delineator Pilot Program permanent in Wisconsin law. The Wisconsin Wetlands Association (WWA) supported this legislation because it ensures the long-term continuation of the Assured Delineator Program and carries forward the efficiencies the program enables for participating consultants, Wisconsin Department of Natural Resources (WDNR) staff, and project applicants.

For nearly twenty years, the Assured Delineator Pilot Program has served the needs of a variety of projects where a precise wetland boundary is needed to meet federal and state regulations. Under the program, consultants meet rigorous performance and professional standards in performing wetland delineations, which in turn provides both the WDNR and project managers with a high degree of confidence in their work. This program has been touted by diverse stakeholders and was recommended to be codified into law by the Wetland Study Council.

WWA appreciates the work of Senator Felzkowski, Representative Mursau, and the Department of Natural Resources for working to develop this legislation, which garnered bipartisan support in both the Senate and Assembly. A wide range of stakeholders also supported the bill.

Main provisions of the program under the 2025 Act 172 include:

  • Establishes a wetland assured delineation program under which individuals may apply to be certified as assured, enabling their wetland delineations to have the same effect as a wetland identification or confirmation prepared by WDNR, and not requiring confirmation by WDNR.

  • Outlines application and renewal processes, fees, and educational/experience qualifications for certification as an assured delineator.

  • Details the process for WDNR to review the performance of assured delineators to ensure that program standards and expectations are being met.
